Trademark Registration Procedure in India

Step 1: Preliminary Search

Step 2: Choosing the Right Class

• Goods and services are categorized under 45 classes (Nice Classification).
• Applicants must select the correct class(es) for their product/service.

Step 3: Preparing the Application

• Application is filed using Form TM-A.
• Decide between single-class or multi-class filing.
• Provide applicant details, trademark representation, and description of goods/services.

Step 4: Filing the Application

• E-filing via IP India portal or physical submission.
• Upload documents and pay prescribed fees.
• Receive an acknowledgment number to track status.

Step 5: Examination

• Trademark Registry examines the application for compliance.
• Objections may be raised under absolute or relative grounds.
• Applicant must file a reply to examination report and attend hearings if required.

Step 6: Publication

• Accepted applications are published in the Trade Marks Journal.
